Terms of Service

  1. 1. Agreement

    These Terms of Service ("Terms") are an agreement between you and Faltah US, Inc., a Delaware corporation ("Faltah", "we", "us"). They govern your use of the Faltah Express app and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

  2. 2. What Faltah is

    Faltah is a technology marketplace that connects people sending parcels ("Senders") with independent people already traveling between cities ("Travelers"). Travelers are not employees or agents of Faltah. Faltah does not own vehicles and is not a motor carrier. When no Traveler accepts a shipment in time, Faltah may offer it to a licensed courier partner, and that courier's own terms apply to the carriage.   3. 3. Eligibility and accounts

    You must be at least 18, able to form a binding contract, and located in the United States. You may hold one account and must keep your sign-in secure. Travelers must complete identity verification with a valid US driver's license before accepting shipments, and must hold any license and insurance the law requires for the vehicle they use.

  4. 4. Prices, payment and holds

    The price of a shipment is shown before you pay: a base fee plus a per-mile rate for the road distance, a charge for weight over 10 lbs, a service fee and any optional extra coverage. Payments are processed by Stripe. Your payment is held and released to the Traveler only after the recipient confirms handoff with the shipment's QR code. Sales tax is added where required and shown at checkout. If a shipment is cancelled before pickup, the amount paid is refunded to the original payment method.

  5. 5. Traveler earnings and payouts

    Travelers are paid through Stripe Connect and must accept the Stripe Connected Account Agreement. Travelers are independent contractors, are responsible for their own taxes, and may receive IRS Form 1099-K where required. Faltah may hold earnings connected to an open dispute until it is resolved.

  6. 6. Prohibited items

    You may not send, and Travelers may refuse: hazardous materials regulated under 49 CFR (including lithium batteries shipped loose, flammables, compressed gases and corrosives); firearms, ammunition, explosives and fireworks; controlled substances, including cannabis across state lines; alcohol and tobacco where restricted; cash, gift cards and negotiable instruments; live animals; human remains; perishable food without suitable packaging; stolen, counterfeit or illegal goods; and any single parcel over 150 lbs. Senders must describe contents truthfully and are responsible for them.

  7. 7. Loss, damage and coverage

    Every shipment includes Cargo Protection: a lost or damaged parcel is reimbursed up to its declared value, to a maximum of $1,000, at no extra charge. You can buy coverage above $1,000 when you book. Parcels are photographed at pickup and drop-off so a claim can be checked. Report problems within 7 days of the expected delivery date through the in-app dispute flow. [TO CONFIRM coverage provider and claim terms.]

  8. 8. Disclaimers

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, FALTAH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

  9. 9. Limitation of liability

    TO THE FULLEST EXTENT PERMITTED BY LAW, FALTAH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND ITS TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE FEES YOU PAID FALTAH IN THE 12 MONTHS BEFORE THE CLAIM OR $100. Some states do not allow these limits, so they may not apply to you.

  10. 10. Indemnity

    You agree to indemnify Faltah against claims arising from your breach of these Terms, the items you send, or your violation of law or of another person's rights.

  11. 11. Disputes and arbitration

    Please contact support@faltahapp.com first; most issues are resolved there. Any dispute that is not resolved will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Rules, except that either party may bring an individual claim in small-claims court. YOU AND FALTAH WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration by emailing support@faltahapp.com within 30 days of first accepting these Terms.   12. 12. Governing law

    These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act for the arbitration clause. Nothing here limits consumer protections that the law of your state of residence gives you and that cannot be waived.

  13. 13. Suspension, termination and changes

    You can delete your account at any time in Settings. We may suspend or close accounts that break these Terms or put others at risk. We may update these Terms; if a change is material we will notify you in the app or by email before it takes effect.
